It&#8217;s strange, the name <strong>AI<\/strong> itself hides something mysterious, unknown, but it&#8217;s our friend today.\u00a0<strong>AI<\/strong> as a term is coming at us from all sides, from morning to night, there&#8217;s basically nowhere to turn. A refrigerator with <strong>AI<\/strong>, a chainsaw with <strong>AI<\/strong>, autonomous driving with <strong>AI<\/strong>, maybe even flushing the toilet has it today \u2026\u2026..It&#8217;s all the fashion. But what it really represents, few people know or think about.<\/p>\n<p>According to Professor Smejkal, AI is divided into two basic categories:<\/p>\n<ul>\n<li><em><strong>AI systems that only process data<\/strong> and cannot influence the physical world. These are our <strong>ChatGBT, DeepSeek, FireFly<\/strong>, etc.<\/em><\/li>\n<li><em><strong>AI systems that can influence the physical world,<\/strong> such as robots, autonomous vehicles, etc. But that is a slightly different world that we are only slowly entering. And if we buy a car with autonomous driving, for example, I know a lot of people who immediately turn it off because it does something they don&#8217;t want, or are afraid of it<\/em><\/li>\n<\/ul>\n<p>But sometimes <strong>AI<\/strong> can also influence the world as part of other systems, such as <strong>SCADA<\/strong> (Supervisory Control and Data Acquisition), <strong>DCS<\/strong> (Distribution Control System),<strong> BMS<\/strong> (Building Management System) or <strong>IoT<\/strong> (Internet of things) control systems. And here we are somewhere else again, because we are discovering that if our furnaces have<strong> SCADA<\/strong>, they are actually quite intelligent.<\/p>\n<p>But that&#8217;s not true. Not even for any of the above items, because it&#8217;s not actually <strong>AI<\/strong>, but a program that someone had to write, which ensures that the binary states of our device will do what we need and are treated in such a way that no conflicts occur, if possible.<\/p>\n<p><em>As Professor Smejkal says, systems and computers still operate according to the <strong>Neumann scheme from 1945<\/strong>. The principle is that the system is controlled by a program written by a programmer, and regardless of complexity, it works on the <strong>if \u2013 then \u2013 else<\/strong> principle. Neither different schemes nor quantum computers have changed this.<\/em><\/p>\n<p><em>The existence of a program controlling the computer&#8217;s work step by step has been preserved. All operating functions and states of the machine are so firmly defined that, although the program can operate very variably, it can never get into a state other than the one predicted.<\/em><\/p>\n<p><em>AI has its own development, as has <strong>Industry 4.0<\/strong>, which can be seen from the following categorization, describing systems without and with <strong>AI<\/strong>.<\/em><\/p>\n<ul>\n<li><em><strong>Zero-generation AI<\/strong> \u2013 systems without feedback, where any failures or changes lead to the next step being disallowed and the system being stopped<\/em><\/li>\n<li><em><strong>First-generation AI<\/strong> \u2013 systems with simple feedback, capable of switching between several subprograms, previously created by a person, and working according to them<\/em><\/li>\n<li><em><strong>Second-generation AI<\/strong> \u2013 systems with the ability to optimize, i.e. the ability to choose the optimal one from pre-specified programs, according to the input criterion<\/em><\/li>\n<li><em><strong>Third-generation AI<\/strong> is characterized by systems that are capable of independent program creation, because they can learn from the acquired experience. Here, only the goal of the activity, the task, is specified in advance, while the method of its fulfilment is left to the intelligence of the control system, which creates the program itself.<\/em><\/li>\n<li><em><strong>Fourth-generation AI<\/strong> is represented by autonomous systems with social behaviour that behave similarly to a person, i.e. they independently choose both the goal of the work and the procedure &#8211; but this is only a hypothetical possibility.<\/em><\/li>\n<\/ul>\n<p>What we know from our surroundings today are systems with <strong>AI of the second generation<\/strong> at most. What does this mean? They learn nothing and are programmed to do everything they are designed to do, as safely as possible.<\/p>\n<p>For example, the autopilot in my car cannot learn to drive better. If I think I drive better, I turn it off because it will never do what I can do. Nothing more. Everything else is just our imagination, which gives the term <strong>AI<\/strong> the significance with which it is used today.<\/p>\n<p><em>According to Professor Ma\u0159\u00edk, <strong>AI<\/strong> today is just a collection of <strong>Turing mathematical models<\/strong> <strong>and algorithms<\/strong>, understanding input and output deterministically. If a program referred to as<strong> AI<\/strong> must follow the programmer&#8217;s commands without the possibility of its own modification, then we can develop it to the level of an expert system, but not further. So, we are still talking about the second generation of <strong>AI<\/strong>.<\/em><\/p>\n<p><em><strong>Higher types of AI can learn<\/strong>, i.e. automatically modify their code based on data, whether provided by a human or collected from the <strong>AI<\/strong>&#8216;s environment. We are talking about machine learning, which occurs autonomously in the sense that it occurs without direct commands or rules set by a programmer.<\/em><\/p>\n<p><em>However, this leads to states of the control system that we cannot define in advance, and it will be difficult to deduce who is responsible for achieving them, if they have a negative impact on the environment or on the robot itself.<\/em><\/p>\n<p><em>The moment non-deterministic, human-uninfluenced, or even uninfluenced elements enter the system, the negative course of the creation and operation of an <strong>AI<\/strong> or <strong>robot system<\/strong> will be a fundamental legal problem of <strong>criminal liability for actions.<\/strong> [1]<\/em><\/p>\n<p>What follows from this? So, if someone decides to launch a third-generation self-learning <strong>AI<\/strong> on the market, they must guarantee that the robot with this <strong>AI<\/strong> will not turn into a murderer.<\/p>\n<p>Hence this topic, criminal liability when working with <strong>AI<\/strong>.<\/p>\n<p>I&#8217;ll end this here for today. It seems to me to be a very relevant topic for the future of heat treatment shops, because there are fewer and fewer of us, and robotization and automation are the only ways forward.
